A spinal cord injury can permanently change your ability to walk, work, and live independently. According to the National Spinal Cord Injury Statistical Center (NSCISC), the historical lifetime cost of a spinal cord injury for a person injured at age 25 ranges from about $2.0 million for a motor functional injury (AIS D) to more than $6 million for high tetraplegia (C1-C4). If your spinal cord injury was caused by someone else's negligence, Florida law allows you to pursue compensation for the full lifetime impact of that injury.
At Louis Berk Law, our Orlando spinal cord injury lawyers work with spinal cord specialists, rehabilitation experts, life care planners, and forensic economists to build cases that reflect the true lifetime cost of your injury. Standard personal injury approaches are often not enough when the injury is this severe. Our catastrophic injury attorneys in Orlando bring additional resources to these cases, and our brain injury lawyers in Orlando handle cases where a spinal cord injury occurs alongside a TBI, which happens often in high-speed collisions.
A spinal cord injury occurs when damage to any part of the spinal cord or the nerves at the end of the spinal canal causes lasting changes in strength, sensation, and body function below the site of the injury. The spinal cord does not have to be severed for the damage to be permanent. Bruising, compression, and loss of blood flow can all cause lasting harm.
Spinal cord injuries are classified by two critical factors: the level of injury (where on the spine the damage occurred) and whether the injury is complete or incomplete.
The ASIA Impairment Scale (AIS) classifies spinal cord injuries from A (complete) to E (normal) based on motor and sensory function below the injury level. Your AIS classification shapes the lifetime care a case must document, because care needs differ sharply between complete and incomplete injuries and between tetraplegia and paraplegia.
Paraplegia results from injuries to the thoracic, lumbar, or sacral regions of the spinal cord and affects the lower body. Quadriplegia, also called tetraplegia, results from injuries to the cervical region and affects all four limbs, the trunk, and potentially breathing and other autonomic functions.
The lifetime cost difference is significant. According to NSCISC data, estimated lifetime costs for a 25-year-old are about $2.97 million for paraplegia and about $6.08 million for high tetraplegia (C1-C4), discounted at 2 percent.
According to the NSCISC's 2024 Facts and Figures, the estimated lifetime cost of high tetraplegia (C1-C4) for a person injured at age 25 is $6,077,646, discounted at 2 percent. These historical estimates cover lifetime expenses and do not include lost earning capacity or non-economic damages, which a life care plan and economic analysis document separately.
Insurance companies know these numbers, and they may try to settle a case for far less than the lifetime cost of the injury. Understanding what the injury will cost over your lifetime is the foundation of a serious spinal cord injury claim.
A life care plan translates these statistics into a case-specific projection. A certified life care planner evaluates your individual needs, including surgeries, rehabilitation, medications, equipment replacement, home and vehicle modifications, attendant care, and psychological treatment. That plan becomes central evidence in the claim.
Nationally, motor vehicle crashes are the leading cause of spinal cord injuries at 37.5 percent, followed by falls at 31.7 percent and violence at 15.4 percent, according to NSCISC data from 2015 onward.
Vehicle collisions cause many spinal cord injuries in Central Florida. High-speed crashes on I-4, the 408, and the 417 produce many serious spinal injuries our team handles. The force of impact in rear-end, T-bone, and rollover collisions can fracture vertebrae or cause disc herniation and cord damage. If your injury came from a crash, our car accident attorneys in Orlando investigate the specific forces involved, and our truck accident lawyers handle cases involving commercial vehicles.
Motorcycle crashes are another common source of serious spinal injuries. Riders who are thrown from a motorcycle often suffer spinal trauma, and our motorcycle accident lawyers in Orlando handle these claims.
Falls account for a significant share of spinal cord injuries. Slip and fall accidents on commercial property, construction site falls, and falls from height all contribute. Violence and recreational accidents, including diving and contact sports, account for other injuries. Surgical complications and delayed diagnosis of spinal compression can also cause or worsen spinal cord damage.
Florida's 2023 tort reform (HB 837) affects spinal cord injury cases through the same mechanisms that affect other catastrophic injury claims. The modified comparative negligence rule under §768.81(6) bars recovery entirely if the injured person is found more than 50 percent at fault. Insurers may argue that a motorcyclist's helmet use or speed contributed to the severity of the injury, and in pedestrian cases they may argue jaywalking or distraction.
The medical damages evidence rule under §768.0427 also applies. For treatment that has already been paid, evidence of damages is limited to the amount actually paid. Unpaid bills are measured by a formula tied to Medicare rates. This makes the life care plan even more important, because it projects the future costs that the paid-bill rule does not capture.
The statute of limitations for spinal cord injury negligence claims is two years from the date of injury under §95.11(5)(a). For people in acute care or rehabilitation, this deadline can arrive while the full extent of the injury is still being assessed. Early legal consultation preserves your rights.
Spinal cord injury victims in Florida can recover compensation for the full range of lifetime damages caused by the injury.

If a spinal cord injury caused the death of your loved one, the estate's personal representative can pursue a wrongful death claim. Our wrongful death lawyers in Orlando handle these cases.
At Louis Berk Law, we assemble the expert team a spinal cord injury case requires before we send a demand letter. We work with spinal cord medicine specialists to document the injury classification, prognosis, and long-term medical needs, and we engage certified life care planners to project the lifetime cost of care.
An insurer is unlikely to offer fair compensation for lifetime care based on a demand that says only that a client is paralyzed. A detailed life care plan and an economic analysis give the insurer the real numbers to evaluate. When the insurance company refuses to negotiate fairly, we prepare the case for trial, and we look for every available source of recovery, including umbrella policies, corporate parent companies, and other defendant assets.
